Unique Conditions That Contribute to Car Accidents in the University/Foothill Area
Heavy rush hours on Foothill Drive and 1300 East can cause severe stress, leading drivers to take risks they would ordinarily avoid. Accident risk is elevated during both the morning and afternoon commutes, with hurried, sleepy, or distracted morning commuters presenting the greatest risk.
Adding to the confusion, high-volume pedestrian crossings near the University of Utah Campus, bicycle traffic, and TRAX riders add to the mix of traffic, and navigating it requires care and focus.
These conditions often lead to complex accidents and liability disputes when they result in compensation claims or lawsuits. Our University/Foothill, Salt Lake City car accident lawyer can investigate your accident and gather evidence to support your case.

How Utah’s No Fault Insurance and Modified Comparative Fault Rules Apply
In Utah, all drivers must have personal injury protection (PIP) insurance. It is a no-fault policy that provides coverage regardless of who caused the accident. Unfortunately, it offers limited relief for people involved in serious accidents. Depending on the circumstances of the crash, you can seek compensation outside of PIP coverage if you have suffered:
- Broken bones
- Loss of a limb
- Disfigurement
- Permanent disability or impairment
- Medical costs over $3,000
However, under Utah Code § 78B-5-818, you only qualify for compensation if your share of fault is 49% or less. If you were less than 50% at fault, compensation is reduced by your share of fault. For example, if you were 20% at fault, you can recover 80% of your damages.

What to Do After a Car Crash in University/Foothill
If your car crash injuries were immediately obvious, you probably wouldn’t have been able to follow some of the regular advice on what to do after a car accident. You might have called 911, but you may not have been able to gather evidence at the scene, talk to witnesses and law enforcement, or exchange details with other drivers. However, the following advice still applies:
- Prioritize medical attention and follow your medical team’s advice
- Notify your insurance company as soon as you are able
- Keep track of accident and injury-related costs
- Avoid saying anything that could be seen as an admission of fault
- Get legal advice and representation early on
- Do not accept any early settlement offers before consulting your lawyer
If you have a case for compensation, your University area Salt Lake City car accident attorney will begin building a case. Acting early helps them seek and preserve evidence before it can be lost, strengthening your case for compensation.

The Deadline for Filing a Car Accident Lawsuit in Salt Lake City
Utah law sets specific deadlines for filing car accident-related lawsuits. Although they might seem to allow plenty of time, your attorney needs to prepare your case. If a lawsuit seems necessary, your attorney will file it before the deadline expires. The following typically apply:
- Personal injury: Per Utah Code Ann. § 78B-2-307, you usually have four years from the date of the accident
- Wrongful death: Per Utah Code § 78B-2-304, you usually have two years to file a lawsuit
- Claims against government agencies: specific, usually shorter, formal notice periods apply
Not all car accident cases lead to lawsuits. Your car accident attorney in University/Foothill, Salt Lake City will negotiate with insurance companies and liable parties. This process can lead to a fair out-of-court settlement. If it does not, they may recommend proceeding to litigation.
How Siegfried & Jensen Handles Your Case
Our clients benefit from our experience in handling barriers to fair compensation. At-fault parties often dispute liability. They may argue that you don’t qualify for compensation or try to reduce their degree of liability. We present an evidence-based case and prepare for objections.
Some accidents involve multiple parties. Provided you were less than 50% at fault, each party that contributed to your accident is responsible for a share of your damages based on their percentage of fault. Your University/Foothill car accident attorney can handle these complex negotiations.
Once we have established liability, there is also a chance that liable parties will dispute your damages. For example, they may claim that some of your injuries were pre-existing or that you did not take proper care of your recovery after the accident. We will work to counter these objections.
