A drug recall is the process by which a pharmaceutical product is either temporarily or permanently taken off the market.

There are several ways in which a drug can be recalled. A pharmaceutical company can choose to instigate a voluntary recall in response to new evidence that a drug is dangerous or ineffective. The negative publicity and financial loss that a drug company may suffer as a result of a pharmaceutical litigation claim can motivate a company to institute a voluntary recall.
The dangerous drug attorneys at the Salt Lake City, Utah–area firm of Siegfried & Jensen are committed to aggressively pursuing your pharmaceutical litigation claim. It is our hope that our efforts will not only help you to obtain fair compensation, but also that your claim may motivate the drug company to recall its dangerous drug.

The Food and Drug Administration (FDA) may also be involved in the recall of a defective or dangerous drug. One of the functions of the FDA is to investigate new information in the form of studies, clinical trials, and patient and doctor complaints regarding the safety and efficacy of drugs. Once the FDA confirms that an approved drug is potentially harmful, they determine whether or not the benefits of the drug outweigh the risks. With this information, the FDA may decide to issue a public warning and request that the warning be added to the drug's label, or it may issue a formal recommendation to the company to recall the product. Most companies comply with an FDA recommendation for a recall. In the rare event that a company refuses to recall a drug that the FDA deems to be a serious threat to public health, the FDA has the authority to use legal channels to seek an injunction or legal seizure of the product to prevent its sale.
The FDA often takes note of claims filed by injured persons against pharmaceutical companies. If you have been injured by a dangerous drug you may be eligible for compensation. Your claim may also lead to an FDA investigation that could result in a drug recall. Contact our dangerous drug lawyers serving Salt Lake City and all of Utah to file your claim.
